General Terms and Conditions of Sale

**Subject and Scope**

Art. 1 - Subject and scope of the general terms of sale

These conditions govern the sale of retreats and sessions organized by the micro-enterprise good-veda. Any registration for one of these retreats or sessions offered on this site implies the buyer's unconditional acceptance of the following general conditions, which prevail over any other document.

**Reservations**

Art. 2.1 - The offer

Any modification of the services offered on the site that may occur before the client's registration will be communicated to them in writing before the conclusion of the contract, which alone will be valid for the services actually agreed upon between the parties.

Cures, retreats, and sports activities: good-veda draws the User's attention to the need to inquire, before ordering the "My Peace Retreat" service, about the ability of all beneficiaries to benefit from it by taking all precautions that their health condition requires. good-veda's responsibility cannot be engaged in case of incidents or accidents.

Art. 2.2 - Reservation

Sales of tourist services are not subject to the right of withdrawal provided for in articles L 121-21 and following of the consumer code for distance selling.

Any reservation of a wellness retreat made through various online sites is final for the client.

Cancellation will only be possible under the cancellation conditions mentioned in article 5 below.

The delivery of travel documents and any information regarding the reserved wellness retreat will be done by email. The client must provide a valid email address during registration and regularly check their email.

The client must inform good-veda, in writing and before any reservation, of any particularity concerning them that may affect the smooth running of the stay (people with reduced mobility with or without a wheelchair, specific dietary requirements, presence of an animal, etc.).

The client's registration for the wellness retreat will only be effective and will only bind good-veda after its confirmation of the availability of the reserved products. This confirmation will be sent to the client by email. The client will receive a confirmation email, followed by a departure confirmation email, and will receive all the necessary information for the organization of the retreat.

**Price**

Art. 3 - The price

Unless otherwise stated in the description, the price displayed for a wellness retreat is a package and never includes: transportation, tourist taxes, visa fees, extras, taxis, tips and porterage fees, personal insurance. The price to be paid by the client will be confirmed at the time of registration and mentioned in the contract.

**Payment Terms**

Art. 4.1 - Payment Policy

To reserve a spot on a retreat, a non-refundable booking fee of 50% of the due amount is required.

The full payment (due amount) is to be paid thirty (30) days prior to the retreat start date.

If your booking is made within 30 days of the retreat date, then the full amount is payable at the time of booking

All bank charges are for the customer account. Should the deposit / balance of payment not be received within the time frame specified, good-veda reserves the right to cancel your booking(s) and to charge the applicable cancellation fees set out below.

We do not offer credit for arriving late or leaving early.

The retreat prices are charged per person and DO NOT include flights.

Art. 4.2 - Default of payment

Non-payment of the travel price by the due date will authorize good-veda to consider the trip as canceled by the client on the day of departure and consequently to invoice the client the full cancellation fees normally due on that date, i.e., 100% of the fees.

**Modification or Cancellation by the Client**

Art. 5 - Modification/Cancellation

Any client's request for the modification or cancellation of their reservation must be addressed by email to the company good-veda at the following address: marjorie@good-veda.com. Any modification is subject to the agreement of the micro-enterprise good-veda and existing availability.

In case of impossibility to make the desired modification, the original contract will remain applicable. Any unvalidated reservation modification by good-veda (change of room, type of reservation, or any activity or element not included in the selling price at the time of reservation) cannot result in a refund, even partial, without the prior agreement of good-veda, before, during, and after the stay. Any activity planned in the program and not consumed (for personal or medical reasons) cannot be subject to any specific commercial gesture.

The date used to define the modification or cancellation deadline resulting in the fees below will be the working day following the receipt of the modification or cancellation request.

Art. 5.1 - Fees in case of modification

Any modification incurs a minimum fee of €25 per file. These same conditions apply in the case of a name change or typographical errors in the names communicated during the reservation. In most cases, on-site modifications are not accepted. However, if accepted, any additional charge, borne by the client, must be paid on-site. Unused services cannot be refunded.

Art. 5.2 - Fees in case of cancellation

The client can terminate the contract at any time before the wellness retreat. The reason for the cancellation must be given to good-veda. It is recommended that the client notify this cancellation in writing. If the client terminates the contract or does not participate in the wellness retreat, good-veda may demand compensation for the actions taken and the expenses incurred.

Cancellation fees:

- More than 60 days before departure: 30% of the order amount + administrative fees

- Between 60 and 30 days before departure: 50% of the order amount + administrative fees

- Less than 30 days before the departure date or no-show: 100% of the order amount + administrative fees

If the stay is not yet confirmed: 0% + administrative fees offered. *Administrative fees amount to a fixed rate of €25 including VAT.

In the context of COVID-19, we urge our clients to be as responsible as possible. If symptoms appear before departure, please get tested and inform us of the situation. In the case of a positive test before the stay, late cancellation is required. Not being a case of force majeure (article 1218 of the civil code), the participant cannot claim a refund or any compensation. We encourage our clients to check with their travel insurance regarding reimbursement procedures for COVID-19 illness.

Art. 5.3 - Contract assignment

Any assignment of a wellness retreat contract or My Peace Retreat under the conditions provided for in Article R 211-7 of the Tourism Code will incur fees, which may amount to the total price of the retreat depending on the date of the start of the cure or retreat. The assignor must inform good-veda of their decision by email addressed to marjorie@good-veda.com no later than seven days before the start of the trip.

Art. 5.4 - Interruption of the trip or stay by the client

Any interrupted or abbreviated trip or stay, or any unused service for any reason other than force majeure as defined in Article 8 below or the fault of good-veda or one of its providers, will not be refunded, even in the case of repatriation. If good-veda has to cancel a retreat or My Peace Retreat for any reason, the persons already registered will be fully reimbursed without being entitled to any compensation. In case of a modification of one of the elements of the contract by good-veda, only the destination, price, and dates can be considered.

Art. 5.5 - Passports, Visas and Documents

It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates in order to participate in an good-veda.

Art. 5.6 - General Waiver – Limitation of Liability

You acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat hosts, and insofar as legally permissible, surrender your right to any cause of action against good-veda arising from any loss or damage to person or property that occurs during a retreat.

You hereby agree to be responsible for your own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.

You hereby certify that you are physically fit and have not been advised to not participate, by any means or in any manner, in any such activity arranged by the retreat hosts by a qualified medical professional. You hereby certify that there are no health-related reasons or problems which preclude your participation in any and all activities arranged by the retreat hosts.

You hereby waive, release and discharge from and against any and all liability from your participation in the trip and  in any and all activities arranged by the retreat hosts, including but not limited to, liability arising from the negligence or fault of good-veda and/or its employees and/or its collaborators and/or its subcontractors, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to you including your trip to and from activities arranged by the retreat hosts,

You agree that this release shall be legally binding upon you personally and all members of your family.

Art. 5.7 - Photo / Video Release Form

You hereby grant to good-veda the right and permission to use photographic material & video in which you are featured and are taken during the course of the retreat. good-veda holds the right to use / republish / copyright, etc. this material for advertising and promotional purposes. You hereby release and discharge good-veda from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

By booking into a retreat you hereby certify that you have read and fully understood the present Terms & Conditions, and you are fully aware that there is a release of liability included, you accept all Terms & Conditions and you agree of your own free will to all Terms & Conditions and applicable policies above. If you do not agree to the aforementioned Terms & Conditions, you are not permitted to participate in My Peace Retreat.
